These Terms of Service (“Terms”) govern your access to and use of jimmyclarkhomes.com (the “Site”) and any related online services provided by Jimmy Clark Homes (“Jimmy Clark Homes,” “we,” “us,” or “our”).
By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1) Who We Are (Informational Website)
The Site provides general information about our homes, floor plans, communities, features, and related services. The Site is not a binding offer to sell, and it does not create a builder-client relationship or contract. Any purchase of a home is governed only by the written purchase agreement and related documents you sign with us.
2) Eligibility
You must be at least 18 years old (or the age of majority in your state) to submit forms or request information through the Site.
3) No Advice; No Reliance
Information on the Site may include pricing ranges, incentives, estimated monthly payments, completion timelines, square footage, maps, school information, availability, and community amenities. This information is provided for convenience and may not be current.
You agree not to rely on the Site as the sole basis for decisions. Confirm all details with a sales representative and/or your own advisors (lender, attorney, inspector, etc.).
4) Plans, Pricing, Availability, and Features May Change
Because construction, supply chains, permitting, and development conditions change, you understand and agree that:
- Prices, incentives, rates, and promotions can change without notice and may be time-limited.
- Availability may change at any time (homes may be sold, reserved, withdrawn, or delayed).
- Floor plans, elevations, specifications, and features may change due to engineering, code, material availability, or builder discretion.
- Renderings, photos, virtual tours, model homes, and marketing materials may show upgrades or options not included in base pricing.
All details are subject to change and are not guaranteed unless specifically included in a signed written agreement.
5) Estimates and Timelines
Any build times, completion dates, or schedules shown on the Site are estimates only. Actual timing may be affected by weather, permitting, inspections, labor/material availability, change orders, and other factors.
6) Financing and Payment Information
If the Site provides financing calculators or payment estimates, they are for illustration only. Actual payments depend on your lender, credit profile, rate locks, taxes, insurance, HOA dues, and other terms. We are not a lender and do not provide legal, tax, or financial advice.
7) Communications (Calls, Texts, Email)
When you submit a form or provide your contact information, you consent to receive communications from us (and our service providers) about your inquiry, including by phone call, SMS/text message, and email.

- Text frequency may vary.
- You can opt out of marketing texts by replying STOP (and you may also request to stop all texts).
- You can opt out of marketing emails via the unsubscribe link.
Consent to marketing communications is not a condition of purchase.

- WE DO NOT WARRANT THAT THE SITE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
13) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JIMMY CLARK HOMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE EXCEED $100.

14) Indemnification
You agree to defend, indemnify, and hold harmless Jimmy Clark Homes and its owners, employees, contractors, and affiliates from claims, damages, liabilities, losses, and expenses (including attorneys’ fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of another.
15) Dispute Resolution; Venue; Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules.
Any dispute arising out of or related to these Terms or the Site must be brought exclusively in state or federal courts located in [Bell County, Texas / Travis County, Texas / Williamson County, Texas], and you consent to personal jurisdiction in those courts.
16) Changes to the Site and Terms
We may modify or discontinue the Site at any time. We may update these Terms from time to time. The “Effective Date” above indicates when the Terms were last updated. Your continued use of the Site after changes means you accept the updated Terms.
17) Severability
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in effect.
18) Entire Agreement
These Terms, together with any policies referenced (including our Privacy Policy), constitute the entire agreement between you and Jimmy Clark Homes regarding the Site and supersede any prior agreements relating to the Site.
